Official Rules
NO PURCHASE REQUIRED TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES
OF WINNING. OPEN TO LEGAL RESIDENTS OF 50 U.S. AND D.C. ONLY. VOID WHERE
PROHIBITED.
1. Eligibility:
Noble Car Sweepstakes (the "Sweepstakes") is open only to legal residents of the fifty (50) United States and the District of Columbia who are at least eighteen (18) years old at the time of entry. Employees, officers and representatives of Noble Automotive, Tanger Factory Outlet Centers, Inc. and their respective subsidiaries, dealers, stores located at Tanger Outlet Centers and the advertising and promotional agencies responsible for the development, administration and execution of this sweepstakes, as well as the immediate family (parents, siblings, children and spouses of each) and household members of each such employee are not eligible. Sweepstakes is subject to all applicable federal, state, local laws and regulations.
2. Sponsors:
Tanger Factory Outlet Centers, Inc., 3200 Northline Avenue, Suite 360, Greensboro, NC 27408.
3. Administrator:
Tanger Factory Outlet Centers, Inc., 3200 Northline Avenue, Suite 260, Greensboro, NC 27408 (”Tanger”).
4. Agreement to Official Rules:
By participating in the Sweepstakes, each entrant fully and unconditionally agrees to and accepts these Official Rules and the decisions of Sponsor, which are final and binding in all matters related to the Sweepstakes.
5. Timing:
The Sweepstakes will begin April 1, 2009 at 12:00:00 a.m. Eastern Time ("ET"), and end 11:59:59 p.m. ET, May 17, 2009 (the "Sweepstakes Period"). Administrator’s computer is the official time keeping device for this Sweepstakes.
a. How to Enter the Sweepstakes:
1) Official entry forms will be available for free at Tanger Outlet Center Customer Service Centers. Fully completed entries can be dropped into the official entry box located on-site during the Sweepstakes Period or 2) go directly to Tanger's web site at www.tangeroutlet.com, locate and click on "Win a Noble Car" icon/button, provide all information requested including your name, address, zip code, and date of birth, and click on the "Register Me To Win" button; you will then automatically be entered in the Sweepstakes or 3) enter by hand printing on a plain 3" x 5" card your name, address including street, city, state and zip code, daytime and evening phone numbers, date of birth, e-mail address optional, and mail, first class postage affixed, in a hand-addressed envelope no larger than 4 1/8" x 9 ½" (#10 envelope) to: Noble Car Sweepstakes, c/o Tanger Outlet Centers, 3200 Northline Avenue, Suite 260, Greensboro, North Carolina 27408.
6. Each entrant may enter the Sweepstakes only one (1) time during the
Sweepstakes Period, regardless of the method of entry.
Multiple entrants are not permitted to share the same email address. Any attempt by any entrant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that entrant's plays/entries and that entrant may be disqualified. All entries must be received during the Sweepstakes Period. Use of any automated system to submit entries is prohibited and will result in disqualification. In the event of a dispute as to any online entry, the authorized account holder of the email address used to enter will be deemed to be the entrant. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential winners may be required to show proof of being the authorized account holder. No mechanical reproduction of entries allowed. Entries become property of Sponsor and will not be returned. Limit one entry per outer postmarked envelope for mail entries.
7. A POTENTIAL WINNER IS SUBJECT TO
VERIFICATION BY SPONSOR OR ADMINISTRATOR, WHOSE DECISIONS ARE FINAL. AN ENTRANT
IS NOT A WINNER OF ANY PRIZE, EVEN IF THE SWEEPSTAKES SHOULD SO INDICATE, UNLESS
AND UNTIL ENTRANT’S ELIGIBILITY AND THE POTENTIAL WINNING ENTRY HAS BEEN
VERIFIED AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE.
8. Method of Determining Winner:
The Grand Prize winner will be selected in a random drawing of all entries received from all entry methods combined by Tanger on or about June 4, 2009 at Tanger’s Corporate office at 3200 Northline Avenue, Suite 260, Greensboro, NC 27408. Winner will be notified by telephone or by registered letter sent to the address listed on the entry. An entrant need not be present to win. Tanger’s decisions are final in binding in all respects.
9. The selected winner must comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements.
Except where prohibited, the Grand Prize winner (and his/her parent/legal guardian sign if winner is an eligible minor in his/her state of residence) must sign and return, within ten (10) days of being notified, an Affidavit of Eligibility Liability and Publicity Release in order to claim his/her prize. If any potential winner cannot be contacted, fails to sign and return the Affidavit of Eligibility, Liability and Publicity Release within the required time period (if applicable), or prize notification is returned as undeliverable potential winner forfeits prize. Prize will be fulfilled approximately 8-10 weeks after the conclusion of the Sweepstakes.
10. Prizes:
Sweepstakes: ONE (2) GRAND PRIZE: Two Winners will each win a Noble Lc Electric Car (MSRP $28,700) *Manufacturer’s suggested retail price, excludes tax, title, license and optional equipment. Winner must be a licensed driver and will be required to provide proof of insurance at time of delivery. Prize does not include, and winner is responsible for, title, license, registration, auto insurance and other third party fees associated with acceptance and use of the prize. Winner must take delivery of prize from the automobile dealership designated by Sponsor. Vehicle will be available for delivery on or about August 31, 2009.
Winner is solely responsible for all federal, state, and local taxes and other fees associated with prize receipt and use. No substitution, cash redemptions, assignment or transfer of prize permitted, except by Sponsor, who reserves the right to substitute the prize with another Noble vehicle model of equal or greater value.
11. Publicity:
Except where prohibited, participation in the Sweepstakes constitutes winner's consent to Sponsor's use of winner's name, likeness, voice, opinions, biographical information, hometown and state for promotional purposes in any media, without further payment or consideration.
12. General Conditions:
Sponsor reserves the right to cancel or modify the Sweepstakes if fraud, technical failures or any other factor beyond Sponsor's reasonable control impairs the integrity of the Sweepstakes, as determined by Sponsor in its sole discretion. In such event, Sponsor reserves the right to award the prize at random from among the eligible entries received up to the time of the impairment. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or any other Sweepstakes, or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately damage any web site or undermine the legitimate operation of the Sweepstakes is a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages and costs (including without limitation, attorneys' fees) from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
Release:
By receipt of any prize, winner agrees to release and hold harmless,Tanger Outlet Centers, their respective officers, directors, members, employees, and agents (“Released Parties”), from and against any claim or cause of action arising out of participation or attempt to participate in the Sweepstakes or receipt or use of any prize.
Limitations of Liability:
Released Parties are not responsible for and entrants release and hold the Released Parties harmless for: (i) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (ii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iii) unauthorized human intervention in any part of the entry process or the Sweepstakes; (iv) electronic or human error which may occur in the administration of the Sweepstakes or the processing of entries, including any loss of entries; or (v) any injury or damage to persons or property, including but not limited to entrant's computer, hardware or software, which injury or damage may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Sweepstakes.
Disputes:
Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes, or any prize awarded, shall be resolved individually, without resort to any form of class action, (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys' fees; and (iii) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.

16. Winners List:
For the name of the winner, available after July 1, 2009, send a separate stamped, self-addressed #10 envelope before December 31, 2009 to: Noble Car Sweepstakes, c/o Tanger Outlet Centers, 3200 Northline Avenue, Suite 260, Greensboro, North Carolina 27408.
